Transfer of Land in Pakistan After the Death of an Overseas Family Member: Legal Procedure and Advisory

When a Pakistani citizen residing abroad passes away while owning property in Pakistan, their legal heirs must follow a defined process to transfer ownership. This involves succession documentation, legal verification, and registration with relevant authorities.

This document outlines the legal framework, procedural steps, and advisory notes for heirs seeking to transfer land in Pakistan after the death of an overseas family member.

1. Legal Framework

Land transference upon death is governed by:

    • Succession Act, 1925
    • Pakistan Land Revenue Act, 1967
    • Relevant provincial land laws and inheritance customs
    • Islamic inheritance principles (where applicable)

The process varies slightly by province but generally requires mutation of property in the name of legal heirs based on verified succession.

    2. Key Steps in the Transference Process

      Step 1: Obtain Death Certificate

      • Secure an official death certificate from the country of residence.
      • Have it attested by the Pakistan Embassy or Consulate.
      • Translate into Urdu if required.

      Step 2: Prepare Succession Documentation

      • Legal heirs must obtain one of the following:
        • Succession Certificate (for movable assets and bank accounts)
        • Letter of Administration (for immovable property)
      • Apply through the Civil Court or NADRA Succession Facilitation Unit (available in select cities).
      • Required documents include:
        • CNICs of all heirs
        • Family registration certificate
        • Affidavits of no objection (NOCs) from other heirs
        • Property documents

Step 3: Mutation of Property (Intiqal)

      • Submit the court-issued certificate or NADRA letter to the local Land Revenue Office or Patwari.
      • The property will be mutated in the name of the legal heirs.
      • Mutation requires:
        • Verified ownership documents
        • Death certificate
        • Succession documentation
        • NOCs from co-heirs (if applicable)

Step 4: Registration and Record Update

      • The updated ownership must be recorded in the Registry Office and Land Record Management System (LRMIS).
      • Heirs may also apply for updated Fard Malkiat (ownership extract) and property tax records.

      3. Special Considerations for Overseas Heirs

        • Heirs residing abroad may authorize a trusted relative or lawyer in Pakistan via Special Power of Attorney (SPA) to complete the process.
        • SPA must be attested by the Pakistan Embassy and registered locally.
        • Video verification and biometric authentication may be required under NADRA’s digital succession system.

        4. Advisory Notes

          • Legal consultation is recommended to navigate inheritance shares, documentation, and provincial variations.
          • Islamic inheritance laws apply unless overridden by a registered will—ensure clarity on shares and heirship.
          • Retain copies of all documents, certificates, and mutation records for future transactions.
          • Avoid informal transfers or verbal agreements—only registered mutation ensures legal ownership.
